Introduction

India's advertising watchdog has raised the compliance bar for food brands — and the clock is ticking. On 8 May 2026, the Advertising Standards Council of India (ASCI) published its Draft Guidelines for Responsible Labelling of Synthetically Generated Content in Advertising — its most significant update in years. These guidelines are aligned with MeitY's amendment to the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules on 10 February 2026, which formally defined "Synthetically Generated Information" (SGI) and made AI labelling a legal requirement across digital platforms.

Key Principle

ASCI is not banning AI in advertising. The framework is risk-based — it mandates transparency wherever AI-generated content could materially influence a consumer's purchase decision. The question isn't whether you used AI. It's whether the AI content could mislead a consumer about the product they'll actually receive.

The Three-Risk Framework Every Food Brand Must Know

Every AI-assisted food brand creative falls into one of three buckets under the new ASCI framework:

High Risk — Prohibited

Cannot publish, even with a disclosure label

  • AI food images that exaggerate appearance, size, texture, or freshness beyond the actual product
  • Fabricated consumer testimonials or fake endorsements
  • Deepfakes of celebrities or public figures without documented consent
  • AI-generated doctors or nutritionists endorsing food products
  • AI before/after weight loss or health outcome visuals the product cannot guarantee
  • Fake restaurant kitchens or locations that misrepresent the brand
Medium Risk — Label Required

Allowed only with a mandatory AI disclosure on the creative

  • AI-generated hero food shots used as the primary product visual
  • AI-generated pour shots, steam effects, or sizzle the actual product doesn't produce
  • Virtual influencers or AI brand ambassadors presenting your food product
  • AI-cloned voices of real people used for brand messaging
  • Realistic AI-generated settings or environments central to the ad
  • AI-powered paid product recommendations in social feeds
Low Risk — No Label Needed

AI-assisted, no disclosure required

  • Routine colour correction, noise reduction, or minor lighting on real product photography
  • AI-generated decorative backgrounds unrelated to product claims
  • Ambient AI-generated music, jingles, or background sound effects
  • Obvious fantastical visual effects audiences know aren't real
  • Using AI tools to write captions, ad copy, or product descriptions

Creative Visualisation on Social Media — What ASCI Allows

Creative visualisation is everything your brand does to present its food or product visually — photography, pack shots, styled shots, Reels, Stories, and thumbnails. Under ASCI's Chapter III (Honest Advertising), the visual must match what the consumer can reasonably expect to receive.

  • Natural steam or condensation the product genuinely produces
  • Colour grading that doesn't misrepresent product's actual look
  • Garnishes/extras shown with clear "not included in pack" label
  • AI-generated decorative backgrounds unrelated to product performance
  • Honest product close-ups — real texture, actual size, true colour
  • Genuine before/after comparisons with proper caveats

✕ ASCI Violation — Do Not Publish

  • Fake steam, glistening, or sizzle effects the product doesn't actually produce
  • Inflated portions showing more food than what's in the pack
  • AI-generated food hero shots presented as real photography, without disclosure
  • Colour manipulation making food look significantly fresher than it is
  • Restaurant-quality styling without a "Serving Suggestion" label
  • CGI or 3D product visuals passed off as actual product photography
  • AI before/after results the product cannot actually deliver
Joint Liability Warning

Under ASCI rules, both the food brand and the advertising agency are jointly liable for creative visualisation violations. Synthetic Visualisation on Online Creatives — How to Declare It

Synthetic visualisation means any image, video, or audio-visual in an online creative that has been AI-generated or materially altered by AI to appear real — AI food photography, AI product shots, AI sizzle and steam, virtual influencers, AI voice-overs, AI-generated environments, and AI before/after content.

Before publishing any AI-assisted creative, run this three-question check:

Q1. Is the AI use central to the ad's persuasive messaging — or does it materially influence whether someone buys the product?

Q2. Would a consumer feel misled if they discovered AI was used to create or alter this visual?

Q3. Does the synthetic visual show performance, results, or product quality the actual product cannot replicate?

Yes to Q1 or Q2 → disclosure label mandatory.
Yes to Q3 → visual must be removed. A label does not make it compliant.

Critical: Labelling ≠ Compliance

Adding a disclosure label does not make a prohibited synthetic visual compliant. If your AI food image exaggerates what the actual product looks like, the label doesn't fix it — the visual must be replaced. Alongside the new AI rules, the FSSAI veg logo mandate applies to every food brand creative. No platform exemption, no format exemption, no AI exemption.

The Mandatory Vegetarian Declaration

All vegetarian food product advertising in India must carry the following verbatim declaration, as prescribed under FSSAI Packaging & Labelling Regulations 2011:

Standard Declaration — Use Verbatim on All Creatives

"This is a 100% vegetarian product. All ingredients used in the manufacture of this product are of vegetarian origin. No animal-derived ingredients, additives, or processing aids have been used. The green symbol displayed on this advertisement is the prescribed mark under the Food Safety and Standards (Packaging and Labelling) Regulations, 2011, issued by the Food Safety and Standards Authority of India (FSSAI)."

TV commercials: Minimum 3 seconds on-screen at ad end. Legible sans-serif, minimum 24pt. White or black text on solid background.

Digital / social media: In creative body or caption. Minimum 8pt / 10px. Must not be cut off by "more" truncation.

What Your Brand Needs to Do Right Now

The consultation window has closed but final guidelines are imminent — expected Q3 2026. Here's the six-step action plan:

  1. Audit live creatives — identify any AI-generated food images or videos currently running without disclosure labels
  2. Update creative briefs — add veg logo placement, declaration text, and AI disclosure as mandatory fields before any creative is produced
  3. Build in human review — all AI-assisted creatives must pass a compliance check before going live: symbol, declaration, disclosure label
  4. Embed, don't overlay — veg logo and AI declarations must be inside the asset file, not added via Instagram or Meta overlay tools after upload
  5. Brief your influencers — brand-supplied creative kits must include compliant assets; influencer contracts must require them to use assets unaltered
  6. Archive AI records — keep AI tool name, version, and approval sign-off for all creatives for minimum 3 years per ASCI audit requirements
